Hit and run

Husband has been charged with hit and run with property damage. Does he need an attorney? What is the punishment if he is convicted? Is it a felony or misdeamor?

The drvier of any vehicle involved in an accident resulting in damage to any property, including vehicles, shall immediately stop the vehicle at the scene of the accident and exchange information with the owner or leave in a conspicuous place on the vehicle or property damaged a written notice giving the name and address of the driver and owner of the vehicle involved along with a statement of the circumstances as well as notifying the police. Any person failing to comply is guilty of a misdemeanor and upon conviction shall be punished by imprisonment in county jail, not exceeding 6 months, or a fine.
