Legal Question in Criminal Law in California

Is it illegal to provide a foot fetish session for money? i.e. foot massage, foot kissing. Is it considered a form of protitution? Nothing that is literally sexual (like oral sex or intercourse) is going on. I live in Los Angeles and i am on probation and I don't want to violiate it.

Here's the answer i just received from another Lawguru Lawyer:

"This oversimplifies things a bit, but to the law prostitution essentially means performing a lewd act for money (or something else of value) in order to gratify one of the participants or the source of the payment.

The law's definition of "lewd act" is a bit nebulous. Your concept of "literally sexual" also seems a bit nebulous, and I would bet that the two are not the same. But without knowing specifically what you do, there's no way I can give you a reliable answer."

To clarify a bit of what i do in a session,

It can be only feet worship, such as massage, feet licking, etc (NEVER a footjob)

Some of the guys are into humiliation so i go by requests, some are into ballbusting, being dressed as girls, to name afew.

The only touching there is is when they massage or kiss my feet, when i kick them or slap them on request. On some occassions, I may see a guy that touches himself (handjob but im not involved whatsoever) or humps a pillow.

Can you please define the line of what may or may not be acceptable so that I can perhaps do something but not others?I need to get extremely clear on this since i cant afford to get in trouble since im on probation.

Thank you very much!

The easy answer is it might just be illegal. The more thorough answer is you have terms of probation. What does your probation officer have to say?

Do you really want to risk the wrath of an over-worked under-paid government employee?
