medical marijuana and probation

1. i have been cited for possetion of less than an once of marijuana.

2. what is the maximum penalty for posetion of less than one ounce of marijuana in contra costa county ?

3. i am a proposition 215 medical marijuana user but my id card has expired i was told by my doctor that the experation date on the card is for club fees and my recomendation still stands what will the judge say about that and what should i do to prepair for my court date ?

4. i am on standard court probation with no special conditions. i have had a few minor violations in the past. but if i present proof of my doctors recomendation at my court date is their still a chance of having my probation violated and how much if any jail time ?

You should not have your probation violated if you are under dr's care for the medical use of marijuana. Possession of less than an ounce is as misdemeanor in California. If you are under 21, you may lose your Drivers license for 1 year. Currently, however, no jail time or probation can be imposed, but a fine of $371 plus assessments may be imposed. If your charge is a violation of previous probation, you may have to answer to penalties involved in that previous case. Call me so we can discuss this. (310) 806-9237
