Legal Question in Criminal Law in California

proper legal representation

my husband is been charged with armed robbery and has not had proper legal representation sicne he was arressted. he has been denied to represent himself twice, has not recieve any discory,or any other type of reports for his case from anyone. he has choosen not to wave time in this matter and have a speedy trial. several mistakes have been made what can me do?

If your husband is being represented by the public defender or a court appointed attorney he can ask for a meeting with the attorney to explain his case to him and to get him the discovery so he can assist in his own defense. If he cannot have a meaningful conversation with his court appointed lawyer, then he can request a Marsden Motion, which is a request to the court to appoint a different lawyer. Your husband would have to show that there is has been a break down in communication to the extent that he cannot have a meaningful defense. Or, if your husband has hired a lawyer, he can always retain a different lawyer and the new lawyer can come into the case. If you have any additional questions, please feel free to contact me.
