Legal Question in Criminal Law in California

Rape by force and burgulary

My son is being accused by an ex-girlfriend of rape by force and burglary. She did not report the alleged incident until two weeks later. There is no other evidence except her word against his.

Re: Rape by force and burgulary

Many rape cases come down to her word against his. The defendants in such cases are often found guilty.

Your son needs a lawyer immediately.

I agree with Mr. Hoffman. Even though it is her word against his, he has the advantage (to an extent) that she waited so long to report it. Please consult with an attorney. If he is found guilty, he will have to register as a sex offender for the rest of his life, and that is a very unpleasant circumstance that will haunt him.

Thank you for your posting on LawGuru.com, and the opportunity for me to help you by responding to your posting.

You actually didn't ask a question, so I'm at somewhat of a loss to answer with specifics, but the seriousness of the offense means that your son needs a good defense and a good attorney as soon as possible, so that every one of his defenses can be presented to the court and prosecutor.

I hope this helps. If you do have other questions, feel that you need legal representation, or want legal advice, please feel free to email me directly at [email protected]. It's my pleasure to help in any way that I can. Thank you.

Re: Rape by force and burgulary

If he is being charged with those crimes, get him an attorney immediately to defend him. Tell him to remain silent. There is no other legitimate advice. He would be foolish to do this without counsel, as a conviction could result in substantial prison time and registered sex offender status. If he has defenses and favorable evidence, the attorney will be able to use them effectively. Feel free to contact me if interested in doing this right, if the case is in SoCal.
