Legal Question in Criminal Law in California

I received an infraction for serving alcohol to a minor in California in 2002 (The citation was originally for a misdemeanor but was reduced to an infraction and a fine). I am now living in Australia and applying for a liquor license to start my own business. The liquor licence questionnaire asks if I have been found guilty of any offence in Australia or overseas. Would the infraction that I received in 2002 still be on my record? Should I disclose it?

I would check with an Australian attorney to find out what the definition of an "offense" is under Australian law. I would want to know whether the term "offense" includes those for which there is no chance of incarceration.

Records are 'forever', and it will show when the check. Fail to disclose it and you'll likely be accused of 'fraud'.
