Legal Question in Criminal Law in California

Time Line

I was accused of a crime 3 years ago and the statute for this crime is 3 years. The actual discovery date is murky. I was confronted on or about 3/1/2004, but now they filed a suite on 3/5/2007 saying it was on or about 3/8/2007. How do you prove it which date it actually was? I feel it's when they confronted me for the 1st time, but that's not the date they are using.

Well, of course they're going to use a date that puts them within the statute of limitations. You can't fight it based on the complaint. You will have to file an answer and probably go through discovery and possibly up to time of trial. It will most likely be your word against theirs.

Answering your question would provide you nothing of value you could use. The argument about dates and statutes will get played out in court. You waiving a print-out of an answer form LawGuru isn't going to stop the case. If you're charged with a crime, get counsel. If you've been civilly sued, get counsel. Defending yourself in either situation is a prescription for disaster. If you have defenses and facts on you side, an attorney can use them effectively, can you?
