Legal Question in DUI Law in California

error on arrest report

I just recieved my discovery papers and my social security # is incorrect by 1 digit. Is this reason to have the case thrown out?

I blew 1.5 and admitted that I shouldn't be driving the night of arrest. My 1st court date is tomorrow and I was going to plea no contest, but I now wonder if this one error is reason enough to have the case thrown out.

Thanks.

Re: error on arrest report

You never plead guilty at the first court appearance. You should request a continuance to allow you to seek the advice of an attorney. Then take the discovery to the attorney and discuss your defenses, if any. The error in the social security number will not result in the dismissal of the the charges. At most it raises a question of fact as to the identity of the driver.
