Legal Question in DUI Law in California

What can happen to a person that gets stopped for not making a complete stop with a suspended license and no insurance in court? can they be arrested? The license was suspended a while back because of 3 DUI's and the person is on summary probation.

Person can be arrested for Vehicle Code Section 14601.2(a) - Driving on a Suspended License and cited for VC 16028. 10 days jail is minimum, up to six months, for the DUI caused suspension charge.

Driving on a Suspended License Mandatory Jail Penalty

If you drive when your privilege is suspended or revoked for driving under the influence of alcohol, upon a first conviction, you face imprisonment in the county jail for not less than 10 days or more than six months and by a fine of not less than $300 nor more than $1,000. [California Vehicle Code section 14601.2(a)]

Moral Of Story: If your license is suspended for 3 DUIs, come to a complete full stop. If they didn't already arrest you, expect a probation violation hearing that could result in substantial jail time. Recommend you bring a lawyer and proof of attendance at every AA meeting you attended since the day you were born.

Did it happen to you or are you just wondering if you should take the chance on driving? Yes, you can be arrested by the police, you have violated the terms of your probation and will be sentenced to the charges on the 3 DUI's and no one will feel sorry for you as three times you have endangered your life and other, innocent people.

Jail time seems very likey. I too would recommend a private lawyer to try to get the best deal possible..Your record looks pretty bad so I would do as many AA meetings as possible, and have the person overseeing the class, sign you out after every meeting on a 5 by 8 card. You might also enroll in a 90 day alcohol program and do as much community service as possible. Then, once you have the best attorney you can afford...........PRAY.....PRAY ALOT..................
