Who's liable?

We had an evening fund raiser for our private school. After the event a faculty member was arrested for a dui. Prior to her leaving, one of her peer told her that she would drive her home. The faculty member in question left while her peer was in the restroom. Is the school liable?

If the only problem was that the faculty member was arrested, the school should have no liability. The school may have provided the alcohol, but did not require the faculty member to either drink nor to drive while under the influence.
