Legal Question in DUI Law in California

missing court

My friend got a dui and has been incarerated due to the fact that it was a parole violation. He has a court day coming up and will not make it because he is in prison. What can I do so that there will not be a warrant put out on him for missing court?

Re: missing court

The fact that he cannot be present at court will result in the court issuing a bench warrant. The issuance of the bench warrant is required for the court to maintain jurisdiction over your friend. You can go to court and tell the judge that he is being held for parole violation. Your friend should also file a request for a hearing on the dui. this will require that the da proceed with the prosecution within a short time or the case will be dismissed.
