While a third offense has certain statutory penalties, actual punishment will vary from Judge to Judge and jurisdiction to jurisdiction. You should consult a DUI lawyer regarding the penalties for the jurisdiction where the charges are filed.

The statutory scheme includes a mandatory minimum of 120 days in custody or 30 days custody attend and complete a 30 month dui program. Additionally, the driving privilege will be revoked for 3 years.

The penalties will depend highly on what your attorney can negotiate and will also vary according to the county in which you are charged.

Word of advice, take it seriously. Also know that the 4th DUI is usually charged as a Felony

Potentially: mandatory jail, stiff fines, revocation of license, alcohol programs, probation, etc. Your attorney's goal should be to negotiate a deal that keeps you out of jail, or minimizes it.
