Legal Question in DUI Law in California

Do I have to pay my 3rd DUI fine when I got a 4th DUI and sentence to prison. My public defender said I don't have to pay at the time of my court hearing and now I have a warrent for non-payment of the 3rd DUI fine. I got court in the morning. Jesse

You wait until the evening before Court to post the question? Yes, you have to pay the fine. The PD did not say you did not have to, only that you did not have to before the court appearance. In considering what sentence to impose upon you for the 4th DUI, the Judge will take into account that a monetary fine has no effect upon you so is much more likely to impose jail time.

For the safety of the public and yourself, the Judge should throw you into jail. Four DUI's means you are an irresponsible alcoholic who is eventually going to cause a vehicle accident in which someone is going to get injured. You should not be driving! You need treatment and to go cold turkey to stop ruining your life and those who love you.

You are required to do whatever the sentencing called for. Why would you think a new arrest would change that? Your PD meant only that you didn't have to pay THAT DAY, and had some time to do so. You never paid, thus the warrant and new 'failure to appear' charges.
