Legal Question in Education Law in California

Can a teacher be sued by a school district for what he writes on a blog attached to a teachers union website? The posting dealt with general tax policies and issues and mentioned no person or organization in particular. The posting resulted in some unofficial parent complaints.

Without further detail, I would think not--unless the comment is defamatory and unless the teacher has a provision in his contract that limits his ability to speak on these issues. Indeed, the union would likely have a duty to defend the teacher if a suit was filed. Any suit would likely be against the union, as well, since they have control over the website and responsibility for managing its content.
