Legal Question in Family Law in California

401k

From 1991 to 2000 I was putting money into a 401k at the job I was at....I was single at the time....I was laid from that job and forgot about the money....In 2005, after being married for 3 years, I received a check for $16,000 ( my 401k)....Now since I opened this 401k before I got married, was/is this money considered community property or is it mine....again i was single when I opened the 401k, and married when I received the money

Re: 401k

Separate property. If you want to keep it separate, put it into an IRA or other account in your own name. Keep a copy of the paperwork.
