Legal Question in Family Law in California

2 years ago my son got a call from cps in New Mexico to come get his 3 yr old daughter, her mother and newborn tested positive for meth. Her mother has custody of her son. My son has had his daughter for two years now. He's trying to enroll her in school ( kindegarten ) they are telling him he needs proof of custody. His last name was never put in the birth certificate. He does have a DNA test that says he is the father and papers from cps that that the mother is unfit due to drug addiction. My son has had his daughter for two years now.
