abstract judgement

I just found an abstract of judgement that was filed for my mom for back child support from 4-1-1968 thru 9-1-77. My mom asked me to see if I could find it because she had heard that it existed and always wondered. I recently got into the mortgage business and realized I could access it from the title company. I found it.

This is what I have it is an abstract of judgement issued on 9-8-78 for 32,844. I am wondering how to I make sure this is recorded again in kern county. I was told that it expired and that is why when my father refinanced his properties the title company did not have to pay the judgement. Please advise how I can have this recorded again so He has to pay if he refinances. thanks Dorothy Austin

You can always file a new abstract of judgment. However, there are some real legal issues here as to whether the statute of limitations, which used to be 10 years and has now been eliminated. I am not answering that question as it would take some legal research, but you should contact an attorney right now to do the research. Unless this was handled by an attorney recently most attorney's won't know the answer to your question off the top of their head. Good Luck, Pat McCrary
