Legal Question in Family Law in California

alimony

We have paid alimony to my husbands ex-wife since 2001. Since 2001 she has had a boyfriend living with her helping pay bills. Is my husband still obligated to pay the full amount awarded to her at the time of the dissolution?

Re: alimony

He must pay the entire spousal support award until there is court order changing the amount. Support cannot be changed after the date it is due, except when a motion to modify support has been filed, and served.

Reply: alimony

In a general sense, Family Code 4323 creates a rebutable presumption of reduced need for a spouse receiving spousal support while cohabiting.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
