Legal Question in Family Law in California

Name on Birth Certificate

My name is not on my 16 mos. old

child's birth certificate. I didn't know

I was the father until child was 16

mos. old. Mother and child are on

welfare now. At this time we are

sharing custody 50/50. By putting

my name on birth certificate am I in

jeopardy of having to reimburse

welfare for child I didn't know I had?

How do I get my name on the birth

certificate?

Re: Name on Birth Certificate

Your name on the birth certificate does not affect whether or no you will be required to pay child support. If you are the father, biologically, you are obligated to support the child. You should talk with an attorney about your current situation so you are prepared when the Department of Child Support Services comes calling. Good Luck, Pat McCrary

Re: Name on Birth Certificate

If you are the father, you most likely will be forced to reimburse the state for child support. My office handles these situations regularly, if you are in the San Diego area, you can call my office for a free consultation.
