ca community property

During our marriage, my mother and brother gave us down payment for us to purchase rental apartment building. The title was under our both name. Although my brother's name was supposed to be in the tltle, the real estate agent was lazy to do that. Now we are in the process of divorce. I am arguing that it is my separate property because the whole down payment was made by my family member. And my wife is contesting that it was a gift to us, so it is community property and she will repay the down payment and interest to my mom and brother.

I need your legal advice.

Generally, it is community property with a right to reimbursement for the downpayment. You will need an attorney on this case. There are many facts and issues that must be dealth with. Good Luck, Pat McCrary
