change in child custody in california

I have had custody for the past 5 years kept child in extracurricular activities do all running for child and I got accused of embezzelment and have not went to trial yet and my exhusband is trying to get custody of our daughter can he do that?

So the basis of his request is that you are accused of embezzlement? What's his point: that the pending criminal charges somehow evidence that you lack proper judgment to parent your child? Anyone can make any argument and its ultimately up to the judge to decide what's best for the child. The father is apparently trying to paint you as an unfit parent, to which you are going to respond by showing what a good parent you are.
