Does a woman I was to marry 12 years ago, who was pregnant and told me before we we're married that the child was not mine have the right to file for child support? The marriage never took place, she admitted to an affair with a man in Mexico and that child was his not mine. She has since been married twice and now single again. This woman has become friends with my sister in law, and has recently asked my sister in law how my marriage and financial situation is. She is now interested in determining whether or not I am the childs father, in persuit of child support. I have seen this person over the years for we live in the same community, and she has never mentioned to me that the child may be mine. Does she have any rights to claim money from me and my family. I have been married for 6 years and have a little girl, and I have no means of being able to take on child support.

The rights do not belong to the Mother as much as they begong to the child. Therefore, the Mother's actions cannot waive the child's right to be supported. The mother can file an paternity action and request DNA testing to see if you are the Father. The tests are very, very accurate and therefore it will determine with close to a certainty whether you are the father. If you are determined to be the father, you will have an obligation to support the child. Good Luck, Pat McCrary
