Legal Question in Family Law in California

Child support?

My husband and I just got married, he has full legal and physical custody. We do not recieve child support for my 9yr old stepson. The ex-not wife left the child with the my husband when he was 5yrs old. She wants us to give her $300.00 a month for her to come down and visit with him..Is this right?! I am on disability and we are tight on money as is. Shouldnt she just be glad she doesnt have to pay us child support? She is getting legal aid to sew us for child custody now and support please help!

It appears you need counsel. If real mom has no custody, she likely will not get support. She may have much to argue to get custody after these years have passed, however, Courts to want to have parents involved. Contact good attorney. First consult usually without charge.

Child support in California is basically set by a computer program. The amount of support is dependent upon the gross income of each parent, and the per cent of time the child is with each parent. The parent with the least contact with the child could receive child support from the parent with the greater custody. Your income would be considered only to the extent that it increases or decreases income taxes paid. There are some other factors that may apply to the facts of your case. Check with an attorney or one of the web sites that give you access to the support program for a small fee.
