Court Never Ordered Child Support

Court never ordered child support, mother of the child doesn't want child support and doesn't want to share custody with the father of the child. No Welfare support, no county support etc has been ordered - under ca law is father following the guidelines especially - is there a legal clause that can be used for justifacation since the father of the child has applied for change ins status for immigration. Immigration services says that the father is supposed to pay child support, mother of the child won't issue an affidavit, child is 8 yrs old and court never ordered child support

I would file a motion for child support in the count you reside at. That way you can get child support issued, and get the support amount accruing.
