Legal Question in Family Law in California

Divorce and health insurance

Ok.. I am wanting to file for divorce however I am needing to have a surgery done and I have medical insurance through my husband. If I filed will I still be on his insurance or would I be removed from it immediately? A friend of mine said I would be on his insurance until our divorce is final. He also said I can ask to be continued on his insurance after the divorce is final as part of Spousal Support. I am confused. Any advice would be greatly appreciated.

Re: Divorce and health insurance

California law prohibits your husband terminating your medical coverage until the marriage is disolved. The date of disolving the marriage can be delayed for several months if necessary to keep the medical insurance in effect until the surgery has been completed and you have recovered.
