Getting a Divorce.

My wife and I are getting a divorce and I will be moving out of our condo. We rent and my name is not on the lease. What is my legal obligation to the payments for the lease?

Re: Getting a Divorce.

As you did not sign the lease, you are not obligated for the duration of the lease. However, it is possible that you could be liable to the landlord under an implied or verbal contract theory. To be safe, you may want to give the landlord 30 days notice as to you only. Likewise, you could be liable for 1/2 30 days rent to your wife after you give her notice you are moving out. Of course, it may not be prudent to continue to live there once you tell her you are moving out.
