Legal Question in Family Law in California

Divorse

My sister put her husband through MEDICAL SCHOOL. ONCE HE BECAME A Dr. AFTER 7 - 8 YEARS OF Marriage and two kids, my sister became a home maker. Left a good career to raise the kids. She used her job and retirement monies to finance him through school. a year after he became a doctor , he now wants a divorse. Is there something to protect my sister, for example, for her to gain some of his future wages.!!! As a doctor his future earning are very high. What he leaves her is child support for two kids and some type of alamony, other than that she has nothing else to live on. The house is new so they have very little equity. The odds are she would have to sell the house! Help PLease adviser

Re: Divorse

The law on this issue is basically that if your sister used community income (her wages during marriage, while he went to school) to pay for the husband's professional education, then the community should be entitled to reimbursment for what was paid. She may be able to obtain a credit for what she paid if seperate property was sued to pay for the medical education. Furthermore, if the husband has started a medical practice the wife may be entitled to 1/2 interest in the value of the medical practice.

Furthermore, the wife may be entitled to spousal support since she is not working.
