Legal Question in Family Law in California

Family Law Motion

I am trying to file a motion to appoint minor's counsel. I have been online trying to find the correct forms and help and this is what I come up with.

1. FL-301 ''Notice of Motion'' form - click on ''other'' and type in that space appoint minor's counsel.

2. fill out FL-310 ''Application for Order & Supporting Declaration'' - click other relieft and stat that I request to the court to appoint minor's counsel.

3. click number 10 ''facts and support'' on the same form FL-130 and check ''contained in attached declaration''

4. Type my statement, evidence, proof on pleading paper as my declaration for the motion to appoint minor's counsel. This will be my attachment.

Please advise if I am going about it the right way.

I really need help. I am unemployed and cannot afford a lawyer anymore. I am just trying to do the best I can for my son.

Any assistant will help at all.

Appointment of minor's counsel is in the discrection of the court. There is no specific form. If you child needs an attorney, so do you. Even if an attorney was appointed for the child, you and the other parent would probably be required to pay for that attorney. I suggest that you seek legal counsel, you may be creating more problems than you expect. Good Luck, Pat McCrary
