Should I file for Divorce or Maintenance?Is it possible to just file for Maintenance without divorce?

I am married to a US citizen and living seperately from him since last 5 years . There have been no divorce or seperation between us legally. I want to file for maintainenance now for myself and our 5 years old son. My question is- Do i have to file for divorce inorder to get maintenance for myself and my son OR Can i just file for Maintenance in USA for myself and my son.

If you have been apart that long why not a divorce? Is there something keeping you together? . You should do something. That better reflects what you are doing and what you want.
