Legal Question in Family Law in California

my husband gives me a small allowance every month for expenses. I am not allowed to have friends. I am barely allowed to speak to my mother on the phone. I have two children from previous marriage, and we have a daughter. He says he will take eveything from me, including the kids. I have never signed a joint tax return, even through I know he files it jointly every year, and we received returns around $5,000. Please advise what my rights are, and how to protect myself. I am unsure of what to do.

if you are being abused you need to speak to the police and get help for any domestic violence. You should speak with a local attorney and bring him copies of your husbands pay stubs and financial documents so he can see what kinds of legal rights you may be entitled to. You need to get more involved and knowledgeable about your finances to be able to come out succesful in a divorce.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
