Legal Question in Family Law in California

Joint Dismissal of Restraining Order

I filed a DV against spouse, we settled prior to hearing however a mutual restraining order giving me our home also gave him control of our corporate headquarters where I worked (bad attorney). Spouse has almost agreed several times to jointly dismiss...however now has moved into Residence and is in violation of order. I cannot get my attorney to move on this. What are my options? It has been almost 2 years and this has caused irreperable harm to my business and business reputation when in fact it was my husband who was the cause of the DV incident and is simply using this as a 'control' factor and negotiating tool to force a 'settlement'. I have repeatedly in writing requested my husband cooperate and he still refuses.

You should consider getting a second opinion from another attorney.
