Are there any laws, citations that a parent's right to custody trump a third party as caregiver during other parent's custodial time, if mother does not work during that period when other party needs child care?

Short answer: no. That said, if one parent is consistently placing the child(ren) in childcare rather than exercising their custodial time and the other parent is available to care for the child(ren), depending on all the other facts and circumstances it might be a basis to seek a modification of the custody order.
