Living Together with Kids

My sister has been living with her boyfriend for 10 years they have three children and she now is wanting to leave, if she leaves and does not take the kids till she is settled is this considered abandonment and could if affect her negatively? Or shoud she leave and take the kids no matter what? I am trying to help advise her she currently is the only one working and supporting the family, she also will be going into the police academy in july.

It is a personal decision for her. I would suggest that she reach an agreement for child sharing before she leave. Otherwise she should discuss her options with a custody attorney who can explain the system to her. Good Luck, Pat McCrary

The general rule is that the parent with the children when the matter goes to court has an advantage. The court does not want to change the custody arrangement without strong evidence that they will do better with the other parent. She should take the children with when she leaves.
