i have an open c.p.s case and am 35 weeks pregnat when my baby is born can i give my newborn to a family member without c.p.s stepping in

You may be able to have a private adoption by the family member prior to the time that CPS steps in to take the child. If you voluntarily terminate your rights in favor of the adoption it is much less likely that CPS will step in.
