Legal Question in Family Law in California

Remarriage of Filipina to American Citizen

I am a U.S. citizen. I have a girlfriend in the Philippines. She is legally separated in the Phils. If she is visiting the U.S., can she obtain a divorce here and marry me?

Re: Remarriage of Filipina to American Citizen

IF SHE IS A RESIDENT OF THE STATE OF CALIFORNIA FOR A PERIOD OF SIX MONTHS SHE CAN OBTAIN A DISSOLUTION OF MARRIAGE. WHEN SHE ARRIVES SHE CAN FILE FOR A LEGAL SEPARATION HERE IN CALIFORNIA AND AFTER SHE HAS BEEN HERE FOR SIX MONTHS SHE CAN AMEND HER ACTION TO A DISSOLUTION AND TAKE A JUDGMENT DISSOLVING THE MARRIAGE. ITS A LITTLE TRICKY AND YOU SHOULD HAVE AN ATTORNEY TO MAKE SURE IT GOES OK. HER HUSBAND WILL PROBABLY BE THRILLED SINCE YOU CANNOT OBTAIN A DIVORCE IN THE PHILIPPINES. GOOD LUCK, PAT MCCRARY
