Legal Question in Family Law in California

re-marriage

I gave my ex-husband notice that I was marrying in June. His wages are being garnished for spousal support. Who is responsible for filing the paperwork in the courts to terminate spousal support? My understanding is that I just need to give him 30 days and he needs to file the appropriate paperwork. Do I give him a copy of my marriage license? I am trying to avoid any additional legal fees on my end because he has cost me a ton in legal fees just to get him to pay support, both child and spousal. Thank you.

Re: re-marriage

It isn't his resposibility any more than it is yours. However, anything you receive which is more than you are entitled to is your responsbility to return, so you need to take care of this.

You need to terminate the wage garnishment, which is not complicated -- for me anyway.
