Legal Question in Family Law in California

i have seperated from my husband we have been seperated for three years coming up this october on our last court date which was a couple years ago i had asked the court if i can have a bifurcation my husband said no so i was not able to get divorce can i ask for one now and can he stop it again? i live in california

You should get an attorney. Generally the court will grant bifurcations. Your husband could not stop it, like it or not. You should call my office at your convenience to discuss this.

Alternatively, why not just finalize the whole divorce? Why bother with a bifurcation? You are not coming up on the end of a tax year, so there is no reason you can't be divorced by the end of the year for tax purposes. You haven't mentioned any need or desire to have a wedding before you could get the whole divorce done. Those are the two main reasons for bifurcation. Your husband shouldn't have been able to stop it, but it sounds like it makes more sense to let him have his way, and just push forward to a final divorce judgment on all issues.
