Time away from the kids

My criminal case was reversed and I was aquitted of all charges after a five year prison sentence.

I have aquired direct proof of my innocence and I am currently seeking full custody. My legal agrument is she lied about the domestic violence inorder to interfer, deny lawful contact and destroy the father child relationship.

Q. 1. Can family court deny me full custody of my son's base on my five years in prison.

Q. 2 Is there any case law you can offer for help.

Re: Time away from the kids

The time away from your children should be considered in regard to how the children relate to you. You did not state the ages of your children when you last saw them and their present age. If the children are young they may not even remember who you are. For their best interests you should have a period of renewing your relationship. As to mother her conduct should weigh heavily against her in any custody decision by the court.
