Legal Question in Family Law in California

getting a wage assignment

neither me or my ex husband reside in our home..it is up for sale and has been for a year now..when I was living in there I paid the house payment but I have been out for almost a year now and pay most of the house payment..He subtracts the money from the child and spousal support he gives me.He is not suppose to do that but right now I dont have money to hire an attorney.can I get a wage assignment?Do I have to prove he has not been giving me the full amount because he is deducting 3/4 of the house payment. Can I have the 4sale sign taken down and move me and our kids back in.We are living with my parents right now.He says I can move back if I buy him out..I dont have the money to buy him out..would a judge agree to allow me to stay in the house and when I sell I will give him his half if I have something written out and notarised?I know I am asking alot but if you have any advice or answers to any question I have.if it makes sense.thank you

Re: getting a wage assignment

If he is not paying you child support, you should contact department of child support services in your county and ask them to help you get a wage assignment. It's helpful in cases when the payor is not fulfilling their duties.

As always please consult an attorney in your area before you take action.

Good luck.
