Legal Question in Family Law in California

Does the wife have full possession of the furnishings and other materials in the house now? This divorce was finalized on Sept. 9, 2011.

"Husband shall go to the marital residence on June 5, 2011 at 10 am to pick up his belongings in the garage, 2 photos, and tools, except those that wife is retaining. The court reserves jurisdiction over any further distribution of the parties belongings."

Well "possession" is just who has them, which it seems she does. The language you quote, however, indicates that who is entitled to own the rest of the furnishings and materials remains an open issue for the court to decide. I would caution you, however, that by waiting this long, and with the current state of court budget cuts and staffing, no judge is going to want to hear from you about personal furnishings that weren't important enough to you to do anything about for a year and a half or so. On the other hand, they are not going to be very happy if the only way you can get any of the jointly owned furnishings is to go to court. So both you and she, but especially you who let this go for so long, will be much better off reasonably working out any issues about you getting some of the household goods.
