Legal Question in Civil Litigation in California

Automobile Repossession

3 years ago I co-signed a car lease with my son (he is now 22 years old and there are still 3 years left on the lease). My son has a gambling addiction and has fraudulently cashed other persons' checks, has been bouncing checks, and is not paying his debts (including the car payment). Yes, the law is involved and he will probably go to jail. VW Credit says that they will repossess the car, auction it off, and hold me liable for their loss. In addition, my credit will be negatively affected for 7-10 years. My son has not been returning my phone calls or calls from other family members in over 2 months. I want to hire someone to take the car from my son and deliver it to me so that I can pay off the lease and sell the car. Who can legally perform this service for me? VW Credit will not disclose the names of people/companies who repossess vehicles on their behalf.

Re: Automobile Repossession

Anyone can repossess the car, as long as they do not "breach the peace" to do so ......... cannot break into a house or garage, must find it sitting somewhere and then pick it up with a tow truck, or if you have keys, just drive it away....
