Legal Question in Civil Litigation in California

Hello, I am asking this on behalf of my mother who is an immigrant. We reside in socal and recently she received a phone call from our county court confirming her name and address as she is apparently being sued. We don't know if it's legit as we have not received any court papers or anything like that yet and because she is illegal we are concerned that ICE can get involved. Is there anyways for me to request the papers on behalf of my mom to see what the situation is? I'm quite concerned as recently a threat was made against her that the person will sue her and deport her. If it is legit and she is being sued would she need a lawyer or what are her rights? I will appreciate the help. Thank you.

I am not practicing in southern California. However, I would find it very unusual that the court would initiate a call to your mother at all. You can go to your local courthouse and ask if your mother is a defendant in a recently filed civil lawsuit. You may want to bring her with you as some court cases are sealed. Your mother, as a defendant, would be allowed to see the filing against her. Also, there are procedures wherein you would have to be "served" with the papers, so all of this sounds very unusual.

I agree with the above response. Court employees do not ordinarily call litigants to confirm their name or address unless directed by a judge. You can look up her name online in the court's website to see if a case is filed against her. Lastly, state courts have nothing to do with the immigration courts and vice versa. So, your mom spittle not be concerned about deportation related to the state Court matter. Her immigration status is irrelevant for the purposes of any such state court lawsuit.
