Legal Question in Civil Litigation in California

need help in CA

Due to a medical error, I received a $280,000. settlement in 2002. I am

awaiting a heart/liver transplant which I probably won't receive in time. My

fiance at the time was preganant with our twins andI have 2 older children

that I raised as a single parent with sole custody.Anyway, to protect my

estate, my mom wanted me to put my new home in her name for better

interest rate and asset protection.This seemed

the right thing to do and I was promised she would then put my name on it

and let me get the equity and they would receive the tax benefits.I came to

find out that they at put a $86,000. lien against my settlement claiming they

paid my medical bills which was a lie since I am fully covered by

Medicare.Anyway, my attys. issued a check for $200,000. at my request so I

could buy the home.The problem is that now they want to sell the home from

under me and only give me the $85,000.down payment. The home is

appraised at over $600,000.Their doing this because I married my Latin

fiance and they always told us that we should only marry caucasian. They are

multimillionaires and only doing this for spite.They make it clear that if I

leave her and small children,I will receive inherit. Help?

The most likely solution to this issue is to file civil suit to clear your title to the property, based upon claim of fraud. All issues must be raised in the one suit, including the lien on recovery, etc. The sooner you act, the more likely you are to see the successful end. You have many issues, which are mixed in with each other.Most of the issues you present are important to other issues y0u present.

You need to act quickly in order to be sure to preserve all of your available options and your rights.

You already have an attorney, but it appears you need to consult with another attorney about your present attorney PLUS OTHER ASPECTS of your problems.
