Legal Question in Civil Litigation in California

car purchase

i recently helped a friend purchase a car with the deal being he would pay it off in a year or put the loan in his name. right now the loan is in my name. he has made every payment but keeps saying he is going to drop the car off and leave it. is there any legal action i can take to prevent that.

Re: car purchase

You're lucky his not disappearing with the car and leaving you with only the debt. Take it and sell it if you want, then decide whether it makes sense to sue him for the loss you'll take on the car [which you'll have to pay off].

Yes. Assuming you are a registered owner, and as your friend is in material breach of your agreement, you may take possession of the car. That would effectively keep your friend from dropping it off.
