Legal Question in Civil Litigation in California

Concrete damage

My next-door neighbor hired a crew to repair the roof of her house. For unexplained reasons, their tar spray-gun exploded and made a mess out of the concrete work on my side of the house. The irony of the matter: i just paid over $3000.00 to install new concrete (one week ago!).

How should I proceed in this matter, resp. who is responsable. The company doing the repair work, or the owner of the house, or both?

Thank you for any advice you can give me in this matter.

Sincerely,

E. Buhlmann

Re: Concrete damage

Mr. Cohen has provided you with good advice. Hopefully, you will be able to resolve your claim with the insurance carriers for your neighbor and their contractor. However, if it cannot be resolved informally, then you may consider seeking redress in small claims court for the cost of repair.

They both are, sue them both if you don't get satisfaction, and let the court sort it out.

Re: Concrete damage

You might approach your neighbor and find out the name of her insurance carrier and the policy number, and make a claim against the policy. Additionally, find out the name and address of the contractor and send a demand letter for the amount of money it will take to repair, and ask them for the name of their insurance carrier as well.
