ContractsAgtreements

Is a contract invalid if it extends beyound the terms (length of time) of the contract?

I am a contingency recruiter and a company wants me to sign a contract that states I will not recruit from thecompany during the terms of the contract and for one (1) year after.

Re: ContractsAgtreements

There are a couple of potential issues here. First is the idea of limiting your ability to compete with the company. This is called a "non-compete agreement" and is generally not enforceable in California.

However, there are other issues that apply such as your use of information and contacts belonging to your company and the relationships that you may have built up over your employment period. These are commonly trade secrets belonging to the company which you can get in trouble with following employment.

Essentially this is an area that you should probably have a consultation with an attorney to discuss your rights and options.
