Use of our family name without permission

I have recently discovered that a company based in Texas and India is using our family name as for there company name without any contact, permission or our involvement.

Our family is small. Anyone with our family name in the United States is related to us. In other words it is not like brown or smith. Our family name is unique.

Do we have any recourse?
