Legal Question in Civil Litigation in California

Internet Payday Loan

I had several internet payday loans. I have paid some, but I have more to pay. I have some companies that I have not made arrangements to pay yet, but I am getting threatening phone calls. What is the worse that can happen with the loans that are still unpaid. The loans were from other states.

Re: Internet Payday Loan

The worst that can happen is that these lenders could sue you, get money judgments against you and garnish your wages and/or levy on (legally seize) any real property you own and/or levy on any non-exempt personal property you own (but only to the extent of your debt, plus interest, expenses and attorneys fees.)

The fact that the remaining unpaid lenders are headquartered in another state will likely not make a difference. Such lenders usually have access to attorneys who can bring suit where you live. Also, sometimes the loan agreement allows the company to sue you where it has its home offices, and then the out-of-state judgment is enforced in the courts where you live.

You would be well advised to consult an attorney who counsels debtors and is familiar with bankruptcy law.
