Legal Question in Civil Litigation in California

Is there liability if a Police Department accidentally put my name in a Convicted Violent Felons Database. My name was placed in this database in 2005. I did not discover this mistake until 2010. I had a professional career (contract computer professional) and have been unable to find work since the day my name was entered into this database. My professional career was destroyed by this mistake. The Police Department removed my name in 2010 and issued an apology but the damage to my career and life is not fixable. I now have a large gap in employment. An explanation that a mistake was made does not change the fact that I have lost those years and employers don't care. It is as if I was convicted of a crime and spent the last 7 plus years in prison.

Is there any recourse for me against the Police department?

It's a bit late now. You would have to have timely filed a claim against the government entity that oversees the police department. The time limit to file a claim would have been within 6 months of when your cause of action arose, which seems to be when you discovered the problem. Additionally, it appears that the statute of limitations has run.

You may want to speak to an attorney that handles these types of cases, in person. You may or may not have a way to toll the statute of limitations, or be able to seek relief from the fact that any claim you file would be late.
