money owed

we were left money in a trust and the trustee claims there is no money left. 3 years prior to the death, the trustee was loaned 70k by the deceased (her mother) when it was actually due to us from our fathers estate. long story. the deceased put us in the trust as a way to pay us back what she saw her daughter not taking care of. do we have a case against the daughter in civil court? is there a limit? the total is $60k between four siblings so for us it's 15k. while there is no document re the loan, there are emails between the deceased and myself which do reference her daughter getting our money as a loan.
